Terms of Use

Welcome to Feelory. These Terms of Use ("Terms") govern your access to and use of Feelory, including quote browsing, saved quotes, personal quote writing, quote customization, Ambient Mode, daily moments, widgets, sharing, wallpaper creation, related content, and related services.
Feelory is provided by Glitters and Smiles d/b/a Tech Glitters ("Tech Glitters," "we," "us," or "our").
By downloading, accessing, or using Feelory, you agree to these Terms. If you do not agree, do not use the App.
1. Who Can Use Feelory
Feelory is intended for a general audience. You may use Feelory only if you can legally agree to these Terms or if your parent or legal guardian agrees on your behalf. If you are under the age of majority in your location, you may use Feelory only with permission and supervision from a parent or legal guardian.
You are responsible for complying with all laws, rules, and regulations that apply to your use of the App.
2. App License
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use Feelory for your personal, non-commercial use on devices you own or control.
We and our licensors retain all rights, title, and interest in Feelory, including the App, software, design, artwork, interface, features, app-provided quotes, collections, themes, animations, icons, logos, trademarks, and other content.
You may not copy, modify, adapt, translate, sell, rent, lease, sublicense, distribute, publicly display, publicly perform, reverse engineer, decompile, disassemble, scrape, extract, create derivative works from, or otherwise exploit Feelory except as allowed by these Terms or applicable law.
3. App-Provided Quotes and Content
Feelory may include quotes, categories, themes, background treatments, animations, cards, wallpapers, and other content provided by us, our licensors, public-domain sources, or service providers.
App-provided content is offered for personal inspiration, reflection, entertainment, and general informational purposes. We do not guarantee that any quote attribution, theme, category, recommendation, reminder, or content item is complete, accurate, current, suitable, or appropriate for every person or situation.
You may use generated quote cards or wallpapers for personal, non-commercial use. You may not use app-provided content, artwork, screenshots, themes, quote collections, or generated assets to build a competing product, dataset, content library, quote database, wallpaper collection, automated service, or commercial product without our written permission.
4. Your Quotes and User Content
Feelory may allow you to write, save, format, copy, share, or export your own quotes and other content ("User Content"). You retain ownership of original User Content you create. You are solely responsible for your User Content and for any consequences of saving, copying, exporting, sharing, publishing, or using it.
You represent and warrant that your User Content does not violate law or third-party rights, is not defamatory, abusive, hateful, harassing, threatening, sexually exploitative, invasive of privacy, infringing, fraudulent, misleading, or otherwise unlawful, and does not contain viruses, malware, or harmful code.
By sending User Content to us, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, store, review, and display that content only as reasonably necessary to respond to you, provide support, investigate issues, enforce these Terms, comply with law, and protect our rights.
5. No Professional Advice or Crisis Service
Feelory is not a medical, mental health, therapy, counseling, crisis response, legal, financial, or professional advice service.
Quotes, reminders, themes, Ambient Mode, and app content are intended for general reflection and personal use only. They are not a substitute for professional advice, diagnosis, treatment, emergency services, or support from qualified professionals.
If you are experiencing an emergency, immediate danger, or a mental health crisis, do not rely on Feelory. Contact emergency services, a qualified professional, or local crisis support in your area.
6. Daily Moments, Notifications, Widgets, and Ambient Mode
Daily moments, notifications, widgets, and Ambient Mode are optional convenience features. Notification delivery is not guaranteed and may be delayed, blocked, duplicated, or prevented by device settings, operating system behavior, battery optimization, app permissions, app updates, network conditions, or other factors outside our control.
You should not rely on Feelory for time-sensitive, safety-critical, medical, legal, financial, or emergency reminders. Ambient Mode and wake-lock behavior may keep your screen active when enabled. Widgets may display quote text or preferences where others may see them.
7. Wallpaper, Photo, Clipboard, and Sharing Features
Feelory may let you copy quote text, generate quote cards, save wallpapers or quote images, and share content through your device. When you save or share content, you are responsible for where it goes, who can access it, and whether you have permission to share it.
We are not responsible for third-party apps, people, platforms, or services that receive content through your clipboard, photo library, gallery, storage, share sheet, messaging app, social network, or other destination.
8. Acceptable Use
You agree not to misuse, disrupt, attack, overload, reverse engineer, scrape, harvest, bulk download, or commercially exploit Feelory or related services. You also agree not to use Feelory to create or distribute unlawful, infringing, abusive, deceptive, harmful, malicious, or rights-violating content.
Without limiting the above, you agree not to use Feelory in a way that causes or is intended to cause harm to any person, device, system, service, property, reputation, legal right, or third-party relationship.
You are responsible for your use of Feelory, your User Content, and any consequences of saving, exporting, publishing, sharing, or relying on content through the App. To the maximum extent permitted by law, Tech Glitters is not responsible for harm, losses, disputes, claims, or damages that arise from your misuse of Feelory, your User Content, your violation of these Terms, your violation of law, your infringement of another person's rights, or your interactions with third-party services, platforms, or people.
9. Online Services and Third-Party Services
Some Feelory features may require internet access or third-party services. Feelory may use Firebase/Firestore to retrieve an updated quote catalog and may use Apple, Google, Flutter, device operating-system services, app stores, notification services, widgets, photo/gallery services, clipboard services, and share-sheet services.
Third-party services are not controlled by us. We do not guarantee their availability, security, performance, policies, content, or behavior. Your use of third-party services may be governed by their own terms and privacy policies.
10. Accounts, Purchases, Ads, and Future Features
As of the Effective Date, Feelory does not require account creation, does not include in-app purchases, and does not include third-party advertising SDKs. If purchases, subscriptions, ads, account features, cloud sync, social features, analytics, or other services are added, additional terms, disclosures, permissions, or policies may apply.
11. Privacy
Your use of Feelory is also governed by our Privacy Policy. Please review it to understand how information is accessed, collected, used, stored, shared, retained, and deleted.
12. Updates and Availability
We may update, modify, suspend, or discontinue Feelory, any feature, or any content at any time, with or without notice, to the extent permitted by law. We do not guarantee that Feelory will always be available, uninterrupted, compatible, secure, accurate, or error-free.
You are responsible for installing updates, maintaining compatible devices, keeping backups where appropriate, and managing local data before uninstalling or changing devices.
13. Intellectual Property
Feelory, Tech Glitters, our logos, app icons, design elements, source code, features, artwork, trade dress, and related branding are owned by us or our licensors and are protected by intellectual property and other laws.
You may not use our names, logos, branding, screenshots, app icons, or marketing materials in a way that suggests endorsement, partnership, sponsorship, or affiliation without our written permission.
14. Feedback
If you send us ideas, suggestions, bug reports, feature requests, reviews, comments, or other feedback, you grant us a worldwide, perpetual, irrevocable, sublicensable, transferable, royalty-free license to use that feedback for any purpose without restriction or compensation to you.
15. Disclaimers
To the maximum extent permitted by law, Feelory is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, security, compatibility, and uninterrupted or error-free operation.
We do not warrant that local data, preferences, quotes, wallpapers, notification schedules, or widget payloads will never be lost or corrupted, that notifications will be delivered at the exact time selected, or that generated images or third-party services will remain available or operate correctly.
16. Limitation of Liability
To the maximum extent permitted by law, Glitters and Smiles d/b/a Tech Glitters and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages.
This includes damages for lost profits, lost revenue, lost data, lost User Content, lost wallpapers, device issues, business interruption, emotional distress, personal injury, loss of goodwill, service interruption, inaccurate content, missed notifications, third-party conduct, or inability to use the App, even if we were advised of the possibility of those damages.
To the maximum extent permitted by law, our total liability for all claims relating to Feelory or these Terms will not exceed the greater of the amount you paid us directly for Feelory in the 12 months before the claim or USD $100.
17. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Glitters and Smiles d/b/a Tech Glitters and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of Feelory, your User Content, your sharing or exporting of content, your violation of these Terms, your violation of law or third-party rights, your unauthorized activity, or any harm or alleged harm caused by your actions.
18. Termination
You may stop using Feelory at any time by deleting the App from your device. We may suspend, restrict, or terminate your access to Feelory or related services if we believe you violated these Terms, created risk or legal exposure, misused the App, interfered with our services, or acted unlawfully.
19. App Store Terms
If you downloaded Feelory from Apple App Store, Google Play, or another app platform, your use of Feelory may also be subject to that platform's terms, policies, and rules. If any platform-required terms conflict with these Terms, the platform-required terms apply only to the extent required.
20. Governing Law and Disputes
These Terms are governed by the laws of North Carolina, United States, without regard to conflict-of-law rules, except where local consumer law requires otherwise.
Before filing a claim, you agree to contact us at contact@techglitters.com and attempt to resolve the dispute informally. To the maximum extent permitted by law, any dispute must be brought individually, not as a class, collective, consolidated, private attorney general, or representative action, and you and Tech Glitters waive any right to a jury trial.
21. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the Effective Date. If changes are material, we may provide additional notice where required by law or platform policy. Your continued use of Feelory after updated Terms become effective means you accept the updated Terms to the extent permitted by law.
22. General Terms
These Terms and the Privacy Policy are the entire agreement between you and us regarding Feelory. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our written permission.
